Clause No. 1: Subject
The general sales conditions described below detail the rights and obligations of the company Sarl ABAT-JOUR-DECO and its client in connection with the sale of the following goods: these are all handmade products manufactured by the company ABAT-JOUR-DECO in the respect of traditions. Any service performed by the company ABAT-JOUR-DECO therefore implies the full acceptance by the buyer of these general terms and conditions of sale.

Clause 2: Price
The prices of the goods sold are those in effect on the day of order placement. They are denominated in euros and include all taxes. The company ABAT-JOUR-DECO grants itself the right to modify its rates at any time. However, it undertakes to invoice the goods ordered at the prices indicated during the order registration.

Clause n°3: Order
Automatic registration systems are considered valid proof of the nature, content and date of the Order.
The company ABAT-JOUR-DECO will confirm to the customer the acceptance of his order by sending a confirmation message to the email address that the latter has communicated. The sale will only be concluded after the sending of the order confirmation.
ABAT-JOUR-DECO reserves the right to refuse or cancel any Order from a customer, particularly in case of insolvency of said customer or in the event of a non-payment of the concerned Order or a previous delivery or a dispute related to the payment of an order anterior.
The mentions indicated by the customer when entering the information inherent to their Order are binding on them. The company ABAT-JOUR-DECO can not be held responsible for errors made by the customer in the wording of the recipient’s details of the Order (delivery address, billing address in particular) and delivery delays or the inability to deliver the ordered Products that these errors could cause.

Clause 4: Products
Our items are created and made to order in our workshop.

Clause No. 5: Delivery
After confirmation of the Order and subject to full payment of the price of the ordered products, ABAT-JOUR-DECO undertakes to ship the ordered products to the delivery address indicated by it under its responsibility. The delivery times mentioned on the purchase order are given for information only. However, the purchased goods will be delivered within a maximum period of 30 working days. The delivery will be made by the company mandated by the company ABAT-JOUR-DECO under delivery against signature. Any delays in delivery attributable to the carrier or the company ABAT-JOUR-DECO do not entitle the customer to claim damages. The ordered Products are transported at the recipient’s risk. Upon receipt of the ordered Products, the customer or the recipient must check the good condition of the delivered item.
We recommend that you check its contents in the presence of a postal services agent, if however the package is found to be damaged you must immediately express reservations regarding its condition to the carrier. We draw your attention to the fact that if you accept the package without issuing a reservation to the carrier and it is damaged due to transport, we will not be able to cover any return costs and the production of a new item.
Are considered cases of force majeure discharging its obligation to deliver, war, riot, fire, strikes, accidents and the impossibility of being supplied.
For reasons of availability of the ordered Products, an Order may be subject to several successive deliveries to the customer.
In the event that the customer wishes to have the ordered Products delivered to two separate addresses, it is appropriate for them to place 2 separate orders.

Clause n°6: Withdrawal-Returns
The customer has a period of 14 days from receipt of the ordered Products. In case of exercise of the right of withdrawal, the company ABAT-JOUR-DECO undertakes to reimburse the sums paid by the customer, free of charge, with the exception of return costs. The refund is due within a maximum period of 30 days. Any return of products must be the subject of a formal agreement between the seller and the buyer. In the event of an apparent defect or non-conformity of the delivered products, which will be noticed by the seller, the buyer may obtain the free replacement of identical products or a credit note excluding damages (except for shipping costs see clause n° 5). In this case, the customer must return the Products new and intact at his expense. The company ABAT-JOUR-DECO does not refund purchases damaged and used. Custom lampshades for the lampshade section: round lampshade, modern conical shape, classic lampshade, square lampshade, rectangular lampshade, cone lampshade, square lampshade, round angle angle rectangle lampshade, clipper, oval lampshade, square pyramid lampshade, lampshadeday rectangle pyramid, pleated lampshade are neither taken back nor exchanged. All customizable accessories are neither returned nor exchanged. Double appliques are neither returned nor exchanged. Products on sale or promotion are neither taken back nor exchanged. Any tailor-made confection or restoration is neither taken back nor exchanged, as they were manufactured at your request in a single piece according to your manufacturing criteria.  No return will be accepted if we have sent you a sample in advance and it has been accepted (valid for all forms) For all orders and purchases (product in stock available immediately) on site passed directly in our store ABAT JOUR DECO 72 rue Amelot 75011 Paris, no return, exchange or refund can be claimed. The items cannot be taken back.  The customer agrees to collect their package within the deadlines imposed by the carrier, in which case if the customer does not collect their package, the carrier will automatically return the package to the sender: SARL ABAT-JOUR-DECO. In this case, the carrier will charge the price of the return costs to ABAT-JOUR-DECO SARL. If the client requests a new shipment, the costs will be borne by the client. In case of request for order cancellation, a penalty of 15€ will not be refunded.

Clause 7: Guarantee
In any case, ABAT-JOUR-DECO cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the receiving country. ABAT-JOUR-DECO’s liability is systematically limited to the value of the Product in question as determined on the date of its sale, without any possibility of recourse against the brand or the company producing the product.
In any case, the client benefits from the legal guarantee of eviction and hidden defects provided for in articles 1625 et seq. of the Civil Code. On the condition that the buyer proves the hidden defect, the seller must legally remedy all the consequences (art.1641 et seq. of the civil code); if the buyer applies to the courts, he must do so within a "short period" from the discovery of the hidden defect (art.1648 of the civil code). Response: within 48 hours.

Clause No 8: Liability
The company SARL ABAT-JOUR-DECO cannot be held responsible for damages of any nature, whether material, immaterial or physical, which could result from a malfunction or misuse of the marketed products. The same applies to any modifications of the Products resulting from the manufacturers.
The responsibility of the company ABAT-JOUR-DECO will, in any event, limited to the amount of the order and cannot be questioned for simple errors or omissions that could have occurred despite all precautions taken in the presentation of products In case of difficulties in applying this contract, the client and ABAT-JOUR-DECO reserves the right, before any legal action, to seek an amicable solution.
Failing this, for merchant clients, the Commercial Court of Senlis is solely competent, regardless of the delivery location and the payment method accepted.
 

Clause n°9: Legal information
The provision of personal information collected for the purposes of distance selling is mandatory, this information being essential for the processing and delivery of orders, the establishment of invoices and warranty contracts. The failure to provide information results in the non-validation of the Order.
In accordance with the law "Informatique et Libertés", the processing of personal information relating to customers has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL).
The customer has (article 34 of the law of 6 January 1978) a right to access, modify, rectify and delete data concerning him, which he can exercise with Store-Factory. In addition, the company ABAT-JOUR-DECO undertakes not to communicate, free of charge or with consideration, the contact details of its clients to a third party.

Clause n°10: The gift card
The amount of the gift card is free. The validity period of the gift card is 1 year from the date of purchase. The delivery of the online gift card is made free of charge by email, or in paper version within 5 working days at the address indicated by the Customer. In case of electronic delivery, the Customer is invited to check that the gift card is not found in their spam messages. The gift card can be used by its beneficiary as a means of payment in one go. The gift card is not refundable. Once the validity date is reached, the gift card will be deactivated.
